SAMPLE PRELIMINARY DEED OF SALE (COMPROMESSO)
This private deed of sale (valid for all legal purposes) is agreed between:

"Prospective Purchaser" (THE PURCHASER)
Who declare that:
The Prospective Vendor agrees to sell to the Prospective Purchaser who agrees to buy for
himself/herself and/or person or entity whose name will be mentioned at the signature of the final
agreement, the following property:

The Prospective Purchaser will pay said amount as follows:

The Prospective Vendor hereby declares that he/she has the power to transfer the above-mentioned property to the
prospective Purchaser free from encumbrances, liens, prejudicial restrictions, real or personal rights of use by third
parties.
The Prospective Vendor declares the compliance of the property with the documents filed at the Land Office and
should that not be the case pledges to regularize the position bearing all expenses.
The ownership of the above-mentioned property, with the consequent active and passive effects, will come into force
in favour and against the Prospective Purchaser from the date of stipulation of the final sale agreement and from this
date rights and burdens will be in favour and against said party.
The final deed of sale will be drawn up by a Notary Public (name and surname of the Notary Public, address), chosen
by the Prospective Purchaser.
The Prospective Vendor declares that the property promised to be sold has been received (the particulars of deed of
provenance or report of hereditary succession)
The technical and connected expenses, fees or taxes for the registration of this agreement and the notary deed of sale will fall on the Prospective Purchaser
